What is Copyright Registration?

According to Section 3 of the Copyright Ordinance 1962, a copyright can refer to any literary, dramatic, musical, or artistic work (other than a photograph). The law protects certain types of works and empowers the copyright holder to enjoy exclusive rights for a stipulated period of time.

Copyright registration in Pakistan is not mandatory, but obtaining a registration certificate from the Registrar of Copyright will prove beneficial in the event of infringement of the copyrighted work. The owner of the copyright will have evidence to present and verify their ownership, in the form of a registration certification.

Procedure of Registration of Copyright in Pakistan

Application for Registering a Copyright in Pakistan

Start by checking if the work you intend to register qualifies for copyright protection and registration in Pakistan. Different types of works have different requirements, such as if it is a literary, artistic, or musical creation. 

The application for each work must be separate and must be submitted to the Registrar of Copyrights. In accordance with the Copyright Form i.e. Form II as available in Rule 4 (i), a copyright application must be filled with a government fee of Rs. 1,000/-.

Consider the following necessities with the application:

  • Application FORM II (To be sent in Triplicate)
  • Statement of Particulars (To be sent in Triplicate)
  • Statement of further Particulars ((For literary, Dramatic, Musical, and Artistic work only) To be sent in Triplicate))
  • Affidavit of the Author
  • Affidavit signed by the Applicant
  • A Pay-order in favor of D.G.I.P.O.
  • Advertisement (Under the proviso to Sub-Section (2) of Section 39 of the Copyrights Ordinance, 1962) Read with Rule-4 (3 A) of Copyright rules, 1967
  • Power of attorney (FORM K) for the firm
  • Board Resolution (in case of a registered company)

Examination

Submit the completed application form along with the required documents and the payment receipt to the Copyright Registration Office of IPO-Pakistan, which will then review the application to ensure it meets all the requirements.

After the examination, the owner will pay the charges by pay order made out to the Director General – IPO. The candidate will then publish the copyright in the newspaper and submit two duplicates to the recorder of copyrights.

Registration

Upon successful processing of the application, the IPO-Pakistan will issue a registration certificate. This certificate serves as evidence of copyright ownership. The copyright registration details, including the name of the owner and the nature of the work, are usually published in the Copyright Journal. Copyright protection is generally granted for the lifetime of the creator plus 50 years. After this period, the work usually enters the public domain.
